Card Members may obtain access to the American Express Card Member Club, with up to two (2) accompanied guests, by showing their valid American Express® Card (excluding American Express Prepaid), subject to capacity limitations. Open daily from Monday, June 10 through Sunday, June 16, 2024, from 9:00am – 7:00pm. Access provided on a first come, first served basis. American Express does not guarantee every eligible Card Member will be able to receive access. Attendees who appear unruly, disruptive, or visibly intoxicated may be refused entrance and may be ejected from the American Express Card Member Club, in the sole discretion of the event organizers. U.S. Open Golf Sweepstakes
ELIGIBILITY: The U.S. Open Golf Sweepstakes (“Sweepstakes”) is open to legal U.S. residents of the 50 United States, the District of Columbia, Puerto Rico, and all other U.S. territories and possessions who are at least 18 years of age or the age of majority in their jurisdiction of residence, whichever is older. Void where prohibited. Employees, officers and directors and their immediate family members (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, of American Express Travel Related Services Company, Inc. (“Sponsor”), its parent, affiliates, subsidiaries and advertising and promotion agencies are not eligible to enter or win. Individuals who are an official, officer, employee, or agent of a government or any department, agency, or instrumentality of a government at any level (national, state, provincial, or local), in any branch of a government, individuals listed on the OFAC Specially Designated Nationals and Blocked Persons (SDN) List, individuals who are located in or operating from a comprehensively sanctioned country or territory (“Sanctioned Territory”), and individuals working for or on behalf of the government of a Sanctioned Territory are not eligible. Accurately complete the official entry form with your email address, first name, last name, street address, city, state, ZIP code, (or US Territory, if applicable), and phone number. You must indicate your agreement with these Official Rules in order to complete your registration. Click the “Submit” button to finalize your entry. By entering, you affirm that you are a U.S. resident and agree to receive information about products, services, and offers from American Express. For information about how we protect your privacy please read our Privacy Statement. All entries must be received by 11:59 p.m. ET on June 16, 2024. Limit one (1) entry per person, per email address. Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, or any other methods may void that entrant’s entries and that entrant may be disqualified, and any potential prize may be forfeited. Entries generated through a third-party website or software or in any way other than the manner set forth in these Official Rules are prohibited, and Sponsor reserves the right to disqualify any entrant(s) using such methods. Drawing: Potential winners will be selected by a random drawing on or around June 19, 2024 from all eligible entries received during the Sweepstakes Period. Sponsor will attempt to notify potential winners by email and/or telephone approximately 10 days from the date of the drawing. Potential winners may be required to execute and return a prize acceptance form, a liability release and, where lawful, a publicity release within seven (7) business days from the date the potential winner is notified. If a potential winner cannot be contacted; does not respond; does not return any required documents within the specified time period; or is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected. Up to three (3) alternate winners may be selected for any prize, after which, such prize will not be awarded. All properly claimed prizes will be awarded, from among the eligible entries received, but in no event will more prizes be awarded than are provided for in these Official Rules. Odds of winning depend on the number of eligible entries received.
Prize: There are five (5) grand prize packages. Each grand prize package consists of the following: One (1) Nike Dri-FIT Golf Polo, (men’s or women’s); approximate retail value (“ARV”) $80.00 each. PUBLICITY GRANT: Each winner, by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), image (including, without limitation, photograph), voice and/or other likeness and prize information for advertising, marketing, and promotional purposes without further compensation, in all media now known or hereafter discovered, in any manner and with any materials, worldwide in perpetuity, without notice or review or approval.
General Conditions: Entrants, by participating, agree that Sponsor, its parent, affiliates, subsidiaries and advertising and promotion agencies, prize provider, and all of their respective officers, directors, employees, representatives and agents, Instagram, and Facebook (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Sweepstakes. Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered or garbled entries, emails, or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes, or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winners by random drawing from all eligible, non-suspect entries received prior to action taken, if possible, or as otherwise deemed fair and appropriate by Sponsor.
Disputes: This Sweepstakes shall be governed by and interpreted under the laws of the State of New York, U.S.A. without regard to its conflicts of law provisions. Entrants hereby agree that any and all disputes, claims, causes of action, or controversies (“Claims”) arising out of or in connection with this Game or these Official Rules shall be resolved, upon the election by entrant or Sponsor, by arbitration pursuant to this provision and the code of procedures of either the Judicial Arbitration and Mediation Services, Inc. (“JAMS”) or the American Arbitration Association (“AAA”), as selected by the entrant. In addition to JAMS or AAA, Claims may be referred to any other arbitration organization that is mutually agreed upon in writing by entrant and Sponsor, or to an arbitration organization or arbitrator(s) appointed pursuant to Section 5 of the Federal Arbitration Act, 9 U.S.C. Sections 1-16, provided that any such arbitration organization and arbitrator(s) will enforce the terms of the restrictions on arbitration provision set forth below. Before beginning a lawsuit or arbitration, the parties agree to send a written notice (a claim notice) to each party against whom a claim is asserted, in order to provide an opportunity to resolve the claim informally or through mediation. Notice to Sponsor must include entrant’s name and address and be sent to American Express ADR c/ o CT Corporation System, 28 Liberty Street, New York, New York 10005. If the claim proceeds to arbitration, the amount of any relief demanded in a claim notice will not be disclosed to the arbitrator until after the arbitrator rules. IF ARBITRATION IS CHOSEN BY ANY PARTY WITH RESPECT TO A CLAIM, NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE THAT CLAIM IN COURT OR HAVE A JURY TRIAL ON THAT CLAIM. FURTHER, NEITHER SPONSOR NOR ENTRANT WILL HAVE THE RIGHT TO PARTICIPATE IN A REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR OTHER PERSONS SIMILARLY SITUATED, OR AS A MEMBER OF ANY CLASS OF CLAIMANTS PERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION. EXCEPT AS SET FORTH BELOW, THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING. NOTE THAT OTHER RIGHTS THAT ENTRANT WOULD HAVE IF ENTRANT WENT TO COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. At entrant’s election, arbitration hearings will take place in the federal judicial district of entrant’s residence or, if entrant elects, the hearings may be conducted remotely. The arbitrator’s authority to resolve Claims is limited to Claims between Sponsor and entrant alone, and the arbitrator’s authority to make awards is limited to awards to Sponsor and entrant alone. Furthermore, claims brought by either party against the other may not be joined or consolidated in arbitration with Claims brought by or against any third party, unless agreed to in writing by all parties. No arbitration award or decision will have any preclusive effect as to issues or claims in any dispute with anyone who is not a named party to the arbitration. The arbitration proceeding and all testimony, filings, documents, and any information relating to or presented during the proceedings will confidential. Both parties agree not to disclose the content of the arbitration proceeding or its outcome to anyone, but may notify any government authority as permitted or required by law. Notwithstanding any other provision in these Official Rules and without waiving either party’s right to appeal such decision, should any portion of this provision be deemed invalid or unenforceable, then the entire provision (other than this sentence) shall not apply.
